Tribal Elections of the Sharlene
Evans [Northern Cheyenne Tribal Secretary] On Friday, August 2, 2006, the Tribal Secretary will
post the Notice Soliciting Candidates at three (3) public
places in each District, advising of the forthcoming primary and general
elections and soliciting candidates. Five (5) Tribal Council seats will
be open, one (1) in the Ashland District, one (1) in the Busby District, and
three (3) for the Lame Deer District. All persons wishing to be candidates must file a Declaration
of Candidacy in person with the Tribal Secretary, accompanied by a
non-refundable $50.00 filing fee paid by certified cashier's check or money
order, by 5:00 p.m., Friday, September 1, 2006. Declaration of
Candidacy forms will be available from the Tribal Secretary. The Voters Committee will review each filed Declaration
of Candidacy to determine if the candidate possesses the
qualifications for office specified in the Amended Revised Tribal Election
Ordinance. Qualifications: 1. Enrolled member of the Northern
Cheyenne Tribe. 2. At least 21 years old on October 3, 2006.
3. Customarily and actually reside in the Ashland District, Busby District,
and Lame District at least six (6) months before the primary election (since
April 3, 2006). The Voters Committee will notify a person in writing
for further clarification. The official updated District Voters Lists have been
posted and it is the responsibility of each eligible voter to examine the
lists to make certain that they are listed in the District that they reside
in. The Revised Election Ordinance, Section 10. Voters and
Voters. Lists. Part b #2 states: "A Tribal
member who customarily and actually resides in one Reservation District
during the entire 90 day period preceding the date set for the primary
election shall vote in that District." In other words, a
person must have lived in a District since July 5, 2006, to be able to vote
in that District primary election. |
If you do not see your name on a District Voters List
and you have lived there longer than 90 days, or you are listed under a name
that you have legally changed, please notify the Tribal Secretary and the Enrollment
Department. Be prepared to present legal documentation, such as a Court
Order for a legal name change. Please accept our apology if we have left
someone on the list whom is deceased or if we placed
your name on the wrong District Voters List. Notify the Tribal

11 Tribal Council members present. #1. Minutes – April 24, 2006 – May 15, 2006 – Sharlene Evans, Tribal Secretary Tribal
Secretary, Sharlene Evans, presented the regular
meeting minutes of May 15, 2006. The
council reviewed the draft minutes for errors and/or omissions. A
motion made by Charles Yellow Fox, Jr. to approve the Tribal Council Regular
Meeting Minutes for May 15, 2006.
Seconded by Matthew Two Moons, Sr.
VOTE: 7-0-1. Motion carried. #2. Budgets – Wilma LaRance,
Tribal Treasurer Wilma
LaRance, Tribal Treasurer presented a resolution
for council adoption, authorizing the re-contracting of certain programs from
the Department of the Interior-Bureau of Indian Affairs. The list includes but is not limited
to: Tribal Court; Prosecution;
Services to Children; Elderly; Families; Scholarships; Aid to Tribal
Government; Youth Emergency Shelter; Water Resources; Natural Resources;
Youth Work Learn; Housing Improvement; Child Find Part B & H; Johnson
O’Malley; Job Placement and Training; Indian Child Welfare Act; Forestry;
Noxious Weeds Welfare Assistance; Community Fire Protection; Wildlife and
Parks; Tribal Services; Transportation Planning and Agriculture
Extension. The Budget Finance
Committee has reviewed these programs and authorizes the re-contraction. A
motion made by Vice President Rick Wolfname to
adopt the resolution authorizing the re-contracting of certain programs from
the Department of the Interior-Bureau of Indian Affairs. Seconded by Charles Yellow Fox, Jr. VOTE: 10-0-0. Motion carried. Wilma
handed out two budgets 1) Fund 246-Summer Youth Work-Learn Program. Discussion followed regarding the eligibility
requirements of youth applying. A
question was raised on the income limit.
Allen Clubfoot explained that there were no income guidelines or
limitations, and that anyone can apply for seven positions. Youth must have an interest in entering the
field of environmental sciences, and do well in the areas of math and
science. The closing date was June 1,
2006. Council members and President
Little Coyote agreed that youth from low income households should be
considered, claiming that they always get left out. President Little Coyote requested to have a
working session on this issue. A
motion made by Joe Fox, Jr. to approve the Summer Youth Work Learn
budget. Seconded by Allen Fisher. VOTE: 11-0-0. Motion carried. Wilma
presented the second budget: 2) Fund 734-State Noxious Weed Trust Fund. A
motion made by Alberta Fisher to adopt the resolution approving the State
Noxious Weed Trust Fund. Seconded by
Charles Yellow Fox, Jr. VOTE: 11-0-0.
Motion carried. Wilma
presented a copy of a Notice from the Montana Department of Revenue regarding
an application for Transfer of Ownership of Montana All-Alcoholic Beverages
License to Jimtown Bar. Discussion of the council included opposing
the liquor license to Jimtown Bar and to comment on
this issue. Another concern was that
in opposing the Liquor License for Jimtown Bar may
effect the Tribe’s Liquor License application for the Tongue River Casino. Alberta
Fisher requested for an Executive Session. Executive

Force Update – Bobbie Anner-Huges, Edwards Law Firm Bobbie
Anner-Huges of the Edwards Law Firm gave an update
on the Tribe’s lawsuit against St. Labre and the
requirements that must be met. She
informed that council that she will be here in the administration building to
visit with tribal members on Wednesday and Thursday, June 7-8, 2006, from
9:00 a.m. to 2:00 p.m. Ms. Anner-Huges requested to meet with the Tribal
Council. A meeting was set for
Thursday, June 8, 2006 at 4:oo p.m. #4. Liquor Ordinance - Alberta
Fisher, Council members presented an ordinance to the council. The ordinance supports and authorizes the
issuance of a liquor license to sell liquor at the Tongue River Casino on
Northern Cheyenne Tongue River Trust Lands.
Discussion on the ordinance followed and tribal council recommended
amending certain language. The council
recommended that language be included to address a percentage of the sales
will be utilized to treat addictions of tribal members. A
motion made by Jace Killsback to adopt a liquor
ordinance with amendments and additions to allow for liquor sales at the
Northern Cheyenne Tongue River Trust Lands.

MT Fish Wildlife
& Parks MOU Re: Barringer Ditch/Time
Frame/Funding Councilman
Joe Fox, Jr. explained the Cooperative Agreement between the Northern
Cheyenne Tribe and the U.S. Fish and Wildlife Service, Region 6. He informed the council that the Natural
Resources Board has review the agreement and supports it. The agreement will address the restoration
of migratory routes for all species and fish passage concerns in the A
motion made by Joe Fox, Jr. to approve the Cooperative Agreement between the
Northern Cheyenne Tribe and the U.S. Fish and Wildlife Service, Region
6. Mr. Fox explained that this
agreement Mr.
Fox also requested that the council enact a resolution to request that the
Bureau of Indian Affairs place the Barringer Ditch
property into trust status when the project is complete. A
motion made by Joe Fox, Jr. to adopt a resolution requesting the Department
of Interior to assist the Tribe in bringing the Barringer
Ditch back into Trust status after the completion of the project. Seconded by Charles Yellow Fox, Jr. VOTE: 9-0-0. Motion carried. #6. Petition on Coal Development - Leroy Pine/Eva
Foote Eva
Foote, presented a “For Tribal Council Referendum”
petition and signatures from each district of tribal members who are for coal
development on the reservation. She stated that 10% of the eligible members
from each of the five districts signed the petition to have a vote on coal
development on the ballot. The
Council went into a lengthy discussion on the pros and cons of coal
development on the reservation, although they agreed that the tribal members
should be allowed to decide, they do not necessarily support coal
development. President Little Coyote
explained that he had made a statement at the Tribal Summit that the
membership must take the initiative to determine the interest for coal
development on the reservation, and to let the people decide. Councilman
L. Jace Killsback made a statement that he is
doesn’t agree with coal development and that if the majority of the tribal
members are in favor of coal development then we no longer have a connection
to our land. Other discussion included
the Tribe’s Class I Air classification and other environmental standards that
may hinder the development of coal on the reservation. A
motion made by Charles Yellow Fox, Jr. to place the question “Should the
Tribe pursue Coal Development on the reservation?” on the November General
Ballot. Seconded by Aljo Strange Owl.
VOTE: 9-0-0. Motion carried. Closing
